An appeal is coming from a Houston pipeline company that’s on the hook for $5.6 million after a court found that it breached a contract and committed fraud by falsely promising a natural gas company a certain quantity of gas each day.

During the “Polar Vortex” winter storms of 2016, it became clear that American Midstream, the pipeline company, couldn’t supply the promised fuel to natural gas wholesaler Rainbow Energy Marketing Corp., which lead to a breach-of-contract dispute that ended in Rainbow’s favor just before the Labor Day holiday. A Harris County court on Aug. 30 awarded Rainbow $5.16 million in damages, prejudgment interest of $449,000, postjudgment interest and court costs. American Midstream took nothing on its breach-of-contract counterclaim, the final judgment said.
