The State Bar of Texas has been under fire from three Texas lawyers since 2019 when they filed a lawsuit, McDonald v. Sorrels. The attorneys claim the bar violates their First Amendment rights by forcing them to join and pay mandatory dues, which the bar then spends on political and ideological programs the lawyers do not support. So far the cross motions for summary judgment are still pending, but two similar cases will soon be taken up in the U.S Supreme Court.

The two new cases will ask the justices to extend the reach of their landmark 2018 First Amendment ruling that invalidated “fair share” union fees to include the legal arena.
