Dallas attorney John G. Browning will serve as a justice on the Fifth Court of Appeals after an appointment by Gov. Greg Abbott on Monday.
But Browning, the Republican nominee for the seat, is only guaranteed to have the bench through Dec. 31, unless he wins an election in November against Democratic nominee Judge Craig Smith of Dallas County’s 192nd Civil District Court.
