Winston & Strawn partner Mike Tomasulo says Roku was able to pick a tech-savvy jury for the first patent trial before U.S. District Judge Alan Albright. The judge also wouldn't let Roku talk about MV3's status as an non-practicing entity, but Tomasulo thinks there might be ways to admit that kind of information in future trials.

The jury has returned its verdict in the first of what's sure to be many patent infringement trials before U.S. District Judge Alan Albright in the Western District of Texas. While the judge's early trial dates and approach to patent eligibility have been a magnet for patentees, jurors had a cool welcome for patentee MV3 Partners and its $41 million claim against Roku Inc.
