One topic where President Donald Trump and former Vice President Joe Biden agree—the country’s infrastructure is due for a major upgrade. Expanding our nation’s infrastructure is a rare area of consensus included in talking points on both sides of the political aisle. Explosive population growth and the need for corresponding infrastructure make Texas a likely recipient of future federal infrastructure dollars.

The expanding infrastructure means more highways, roads, railways, electric transmission lines and pipelines in Texas. The right-of-way for many of these projects will be taken from private property owners through the government’s use of eminent domain. Private property owners have the right to recover just compensation for the taking under the U.S. and Texas constitutions; however, just compensation is often disputed and resolved through litigation.  More Texas property owners may go through the condemnation process if the future administration follows through on its campaign promises.
