A growing litigation trend and risk for oil and gas is an increase in Royalty Litigation, an area in which Reed Smith’s Energy & Natural Resources team has done extensive work. Typically, when energy prices sink, costs remain the same, and litigation brought by landowners seeing diminished royalty returns rise. So, it comes as no surprise that the fall of crude prices last spring was followed by a rise in royalty class actions brought by the plaintiff’s bar.
