Attorneys for Texas on Wednesday urged a federal judge to not block the state’s law targeting abortions after a fetal heartbeat is detected, arguing the U.S. Department of Justice cannot sue the state over the law and that the measure is constitutional.

The filing is in response to DOJ’s motion for a preliminary injunction blocking a Texas law that authorizes civil lawsuits against abortion providers and others who help people obtain the procedures. The Justice Department is alleging Texas “devised an unprecedented scheme that seeks to deny women and providers the ability to challenge S.B. 8 in federal court.”
