The Court of Appeals for the First District of Texas was split over whether a kolache was the culprit of a sudden case of food poisoning that eventually led to a $400,000 jury verdict for a Texas woman.

In a 2-1 majority, the state appellate court reversed that verdict, saying there was legally insufficient evidence that the kolache purchased from Murphy’s Deli in the Surlock Tower at Houston’s Texas Medical Center caused Keziah Jordan’s acute food poisoning in February 2015.
