In a case that tests the limits of judicial authority, the state’s child protective services agency is pleading for emergency relief, and claiming abuse of discretion by a San Antonio family law judge.

The general counsel for the Texas Department of Family and Protective Services submitted a motion, In Re The Texas Department of Family and Protective Services, for temporary emergency relief and a writ of mandamus in late January to the Fourth Court of Appeals.
