A U.S. Sentencing Commission report found wide differences in the rate some circuits granted compassionate release during the pandemic, because guidelines on the criteria for early release haven’t been updated since before the onset of the coronavirus pandemic.

The report, released Thursday by the independent agency, found that six circuits granted relief at an above-average rate from October 2019 to September 2020, including the First Circuit (at 47.5%), the Ninth Circuit (at 37.3%) and the Seventh Circuit (at 36.6%). The overall grant rate nationally was almost 26%.
