A real estate development group, claiming a right of free speech defense in a land dispute with the national retailer Ross Dress for Less, lost on appeal a motion to dismiss.

Ross sued the defendants after they refused to provide an easement for a 250-acre tract that Ross had acquired to construct a 2 million-square-foot warehouse and distribution center, a $300 million project intended to service more than 1,800 stores nationwide.
