A federal appellate court disagreed with a trial court’s finding that a temporary worker may  be treated differently, if there is a challenge based on alleged disability discrimination.

The lawsuit, Gosby v. Apache Industrial Services, at first appeared dead. It was dismissed April 2021 after U.S. District Judge Michael J. Truncale of the Eastern District of Texas in Beaumont decided Arlicia Gosby had not established a prima facie case for an Americans with Disabilities Act discriminatory firing.
