A West Texas oil and gas parts supplier successfully raised a novel statutory argument to avoid paying overtime in a wage dispute with a former employee truck driver.

The defense attorney, Michael Lombardino of the Reed Smith firm in Houston, said this was the first time the defense had been used in states where the U.S. Court of Appeals for the Fifth Circuit has jurisdiction, and has rarely been used elsewhere.
