Lyrics by Grammy-winning rapper Jeffery Williams, aka Young Thug, are being used as evidence in a massive RICO-based gang indictment against him, leading many of his fans and pundits to argue that song lyrics are a form of speech protected under the First Amendment.

Without getting into the specific NSFW details of the lyrics in issue, prosecutors argue that they are justified in using Young Thug’s lyrics as evidence in a criminal case in which he is a defendant because the lyrics are incriminating by connecting him to felonies.
