The Texas Supreme Court settled a dispute over the adjudicatory limits of the Texas Commission on Environmental Quality in water rights disputes, holding that such cases must be heard judicially.

The court’s decision is welcomed news to the commission, which filed an amicus curiae brief in opposition to a Tenth District Court of Appeals opinion that would have given the TCEQ authority to decide water rights disputes.
