The Dallas appeals court, grappling with a thorny issue of standing for a bankruptcy trustee in another person’s personal injury suit, reversed a district court summary judgment to allow the trustee to sue on behalf of a third party.

The opinion in this personal injury suit establishes new criteria within the Fifth District Court of Appeals on standing and the ability of a party to relate back to an earlier petition to overcome a statute of limitations bar.
