The Fifth Court of Appeals agreed to revive a lawsuit against The Boeing Co. brought by Southwest Airlines pilots who claim they suffered damages because of the grounding of the 737 MAX fleet.

A Dallas County district court twice dismissed lawsuits brought by the 8,794 member pilots via its union, Southwest Airlines Pilots Association. They allege the catastrophic crashes and consequent grounding worldwide were the result of false representations about the aircraft and translate to millions of dollars collectively lost because of canceled or reduced flights.
