Five electric power companies with interests for or against a Texas law that the U.S. Court of Appeals for the Fifth Circuit had already found to be the most protectionist of any state have been allowed to participate in a district court lawsuit.

In August, Law.com reported that the Fifth Circuit reversed a dismissal of a suit brought by NextEra Energy, the parent company of Florida Power & Light, against the commissioners of the Public Utility Commission, the state agency that regulates electric power providers.
