Efforts to more equitably distribute patent infringement lawsuits in the Texas federal courts have resulted in a resurgence in cases going to the Eastern District, bringing it to near parity with the Western District’s most prolific patent judge.

According to a Lex Machina report, Judge Alan Albright’s dominance in the Western District-Waco Division has been significantly diminished since then-Chief Judge Orlando Garcia issued an order in July 2022 to randomly assign patent cases among 12 Western District judges, whereas before they were automatically assigned to Albright.
