Dallas Court of Appeals Chief Justice Robert D. Burns III denied a motion for en banc reconsideration in an insurance case where State Farm of Lloyds is being allowed to delay payment of an appraisal award without consideration of inflationary costs caused by the delay.
Five Dallas Court of Appeals justices dissented Wednesday, arguing an en banc hearing has merit, or in the alternative the Texas Supreme Court should consider review.
