Gomez-Perez v. Potter

The Supreme Court reversed a decision of the U.S. Court of Appeals for the 1st Circuit in a case involving age discrimination in which a 45-year-old postal worker claimed that her employer had violated the federal-sector provision of the Age Discrimination in Employment Act of 1967 by subjecting her to various forms of retaliation after she filed an administrative ADEA complaint. The Supreme Court held that Section 633a(a) prohibits retaliation against a federal employee who complains of age discrimination, reversing the 1st Circuit, which held that the Section 633a(a) prohibition on "discrimination based on age" did not cover retaliation.
