In a per curiam Order handed down March 17, Austin’s 3rd Court of Appeals denied the state’s motion for reconsideration en banc in Ex Parte Colyandro and Ex Parte Ellis.
On Aug. 22, 2008, a 3rd Court panel held in those two cases that the state’s money-laundering statute in effect in 2002 did not cover checks, raising the possibility of dismissal of indictments against former U.S. Rep. Tom DeLay, R-Sugar Land, and two political associates, John Colyandro and Jim Ellis. DeLay did not file an application for writ of habeas corpus with the 3rd Court.
