The Texas Supreme Court has a message for trial judges who disregard jury verdicts by granting motions for new trials: You’ve got some ‘splainin’ to do.
On July 3, a divided high court granted mandamus relief in three cases in which trial courts had tossed out jury verdicts by ordering new trials with little explanation: In Re: Columbia Medical Center of Las Colinas, et al.; In Re: Baylor Medical Center at Garland; and In Re: E.I. du Pont de Nemours & Co. In each of the decisions written by Justice Phil Johnson, the high court by a 5-4 vote ordered the trial courts to detail their reasons for granting new trials.
