Gov. Rick Perry named two new appellate court justices last week. But it was the announcement by John Cayce, chief justice of Fort Worth’s 2nd Court of Appeals, just months away from the March primary elections, that set up an odd political situation.

Cayce announced on Nov. 30 that he will resign from the bench effective Dec. 31 to join Fort Worth’s Kelly Hart & Hallman. Pursuant to §202.0065 of the Texas Election Code, because his resignation will occur less than 62 days before the March primary elections, Democratic and Republican officials will choose the candidates whose names appear on the November 2010 ballot to run for Cayce’s unexpired term, which ends Dec. 31, 2012.
