In a Dec. 1 decision in Morgan, et al. v. Plano Independent School District, et al . , the 5th U.S. Circuit Court of Appeals affirmed a lower court’s decision upholding the Plano Independent School District’s 2005 policy regulating when and where students can distribute materials unrelated to the curriculum, including religious materials.

However, the 5th Circuit’s three-judge panel — made up of Judges Carolyn Dineen King, Patrick Higginbotham and Edith Brown Clement — reversed a March 30 decision by the U.S. District Court for the Eastern District of Texas in Sherman regarding the school district’s 2004 policy.
