A suspended judge accused of wire fraud, mail fraud and making a false statement to a federal agent goes to trial this week in the U.S. District Court in El Paso. The prosecution involves the honest-services statute currently being challenged in three cases before the U.S. Supreme Court, one of which is Skilling v. United States , the appeal of former Enron Corp. chief executive officer Jeffrey Skilling.

Manuel Barraza originally was scheduled to go to trial on Nov. 2, 2009, but U.S. District Judge Frank Montalvo of the Western District of Texas in El Paso reset the trial for Jan. 19. Montalvo reset the trial after he granted El Paso solos Victor Falvey’s and Gary Hill’s motions to withdraw from representing Barraza. Falvey and Hill each did not return a telephone call seeking comment before presstime on Jan. 14.
