John Cayce retired as chief justice of Fort Worth’s 2nd Court of Appeals on Dec. 31, 2009. But the Texas Ethics Commission (TEC) staff contended Cayce had a duty to file a campaign finance report on July 15. In the end, Cayce avoided a monetary penalty for filing it late.

Tim Sorrells, the TEC’s deputy general counsel, points out that Article 16, §17 of the Texas Constitution provides that a state officeholder continues to hold office until his successor is “qualified.”
