Daves v. State

In the first point, appellant complains that the trial court erred when it overruled her motion to suppress the fruits of what she perceives to be an unlawful search and seizure. In her second point of error, appellant maintains that the evidence is legally and factually insufficient to support the conviction. OPINION

A jury found Tracie Lee Daves guilty of the offense of possession of a controlled substance (cocaine) in an amount of one gram or more but less than four grams. That same jury assessed her punishment at confinement for three years, and it recommended that the court suspend the sentence and place her on community supervision. In accordance with the jury’s recommendation, the trial court placed Daves on community supervision for a term of six years. We affirm.

Appellant presents two points of error. In her second point of error, appellant maintains that the evidence is legally and factually insufficient to support the conviction.
