On Aug. 31, a jury declined to award damages to a dump truck hauler who was injured when a load of dirt fell on him. In 2007, Lucio Rodriguez went to unload the dirt from his truck when it fell on top of his head. He blamed Craig Lloyd Winter and DCD Construction Co., claiming Winter overloaded his truck, causing a “camel’s hump.” He sustained a blast fracture of the thoracic spine. Defense counsel argued that Rodriguez was obligated to inspect his load before and after unloading. Winter claimed that Rodriguez never inspected the load when he reached his destination. Instead he just raised the trailer to dump the dirt.
