Even though he nonsuited his defamation suit against a Dallas lawyer on Feb. 11, 44th District Judge Carlos Cortez is seeking a protective order to seal documents related to that case, including his deposition. One of the documents currently filed under seal is the sworn statement of Melinda Henry, who earlier this month filed a suit seeking child support from Cortez, whom she alleges is the father of her son, born in 2006.

Lawyers representing Cortez appeared before visiting Judge Richard Davis on Feb. 14 to argue that Cortez’s deposition in the defamation suit should be sealed. Lawyers for defendant Coyt Randal “Randy” Johnston, a partner in Johnston uTobey, appeared at the hearing to oppose Cortez’s request for a protective order.
