A Brooklyn man known to neighbors as “the Flying Rabbi” cannot get damages from TV host Jimmy Kimmel and ABC Inc. for using a video clip of him uploaded to YouTube without his consent as part of a comedy segment, a state judge has ruled.
Brooklyn Supreme Court Justice David I. Schmidt (See Profile) dismissed the lawsuit, Sondik v. Kimmel, 30176/10, on Dec. 14, finding that Mr. Kimmel’s right to satirize the news trumped the plaintiff’s privacy concerns.
