Killer whales may be apex predators in their natural environment, but when it comes to constitutional law they could learn a thing or two from Fulbright & Jaworski’s Theodore Shaw.

On Wednesday San Diego federal district court judge Jeffrey Miller dismissed a lawsuit brought by People for the Ethical Treatment of Animals against the amusement park SeaWorld. The decision brings a swift end to PETA’s novel claims–brought on behalf of five orca plaintiffs–that SeaWorld “enslaves” whales in violation of the Thirteenth Amendment (you know, the one enacted after the Civil War banning slavery of human beings).
