A Philadelphia Common Pleas Court judge has ruled that the best forum for a Texas woman who says her mesothelioma was caused by exposure to asbestos from laundering the clothes of her father, ex-husband and current husband is not Philadelphia but the Lone Star state.
Plaintiffs Deborah F. Gibson and Lark Gibson argued that forum was appropriate in Pennsylvania because the defendants they are suing “willingly marketed” asbestos-related products in Pennsylvania; that they have already incurred costs since they filed their lawsuit Sept. 21; and that case law strongly favors a plaintiff’s choice of forum, according to the Feb. 10 opinion by Philadelphia Common Pleas Court Judge Sandra Mazer Moss in Gibson v. Allen Bradley Co . Mesothelioma is a rare form of cancer that is a signature injury of asbestos.
