Alleging that the delay in their case has deprived them of their constitutional rights to due process, plaintiffs in a class action pending more than four years at the Texas Supreme Court have sued each of the court’s nine justices.
Southwestern Bell Telephone Co., the defendant in the underlying class action, Marketing on Hold v. Southwestern Bell Telephone Co., filed an interlocutory appeal with the Texas Supreme Court in November 2005. The Supreme Court heard arguments in the case on March 22, 2007.
