MEDICAL MALPRACTICE
Doctor not liable for death of Jehovah’s Witness
On Feb. 16, a doctor wasn’t to blame for a Jehovah’s Witness who died because she refused a blood transfusion. Cynthia Hernandez was under the care of Dr. Michael J. Piegari, who performed a Cesarean section. Soon after the delivery, she developed hypotension and a rapid heart rate. Piegari was called back to the hospital. He found that she was bleeding internally and lost 4 liters. Her husband wouldn’t permit a transfusion. Her family claimed that Piegari should have sent her into surgery before he even arrived at the hospital. The doctor argued that he couldn’t have known that surgery was needed until after he examined her. He also noted that she signed a consent form acknowledging the risk of death from internal bleeding.
