The 5th U.S. Circuit Court of Appeals will consider a case that poses an important employment law question: Does Title VII of the Civil Rights Act of 1964 protect women from discrimination if they want to use a breast pump at work while lactating?
Mark Oberti, a partner in Houston’s Oberti Sullivan who represents the defendants in Equal Employment Opportunity Commission v. Houston Funding II Ltd, et al., says the case presents an issue of first impression at the 5th Circuit.
