Nelson v. Pagan

The trial court granted judgment for the defendants, the appellees, in this defamation suit. When the burden of proof shifted to appellants, they did not raise a fact issue regarding whether appellees acted in reckless disregard for the truth or falsity of the statements made in the article and the blog posts at issue, as required to defeat summary judgment on the issue of actual malice. The trial court's judgment is affirmed. Dallas Court of Appeals, No. 05-09-01380-CV, 08-08-2012.
