Man didn’t attack his ex-wife’s husband, jury finds
On Nov. 13, 2012, a jury sided with a man who was accused of attacking his ex-wife’s husband. Martin Barrash claimed that Charles Scruggs assaulted him when Scruggs arrived to pick up his child from his ex-wife. Scruggs claimed that Barrash attempted to interfere with his legal right to leave with the child. He claimed Barrash repeatedly poked him in the chest and then he reacted by brushing away Barrash’s arm. He claimed there was no other physical contact. Defense counsel argued that Barrash’s accounts of the incident were inconsistent, arguing his police statement claimed an injury to his left arm while his medical records and court testimony placed the injury on his right arm.
