Driver paralyzed in collision settles for $8.7 million
A driver who was left with incomplete quadriplegia after he rear-ended a tractor-trailer agreed to an $8.7 million settlement on June 12. Mike Allen struck the truck as it was about to make a right turn into a hydraulic fracturing site. The driver for Heckmann Water Resources (CVR) Inc. was stopped and didn't have his turn signal or hazard lights on. The plaintiffs' accident reconstruction expert opined that Poskey should have turned from the shoulder instead of blocking the right lane. Also, there were numerous prior collisions involving Heckmann drivers at this site. Allen sustained a cervical fracture and underwent an emergency multi-level cervical fusion with permanent placement of rods and screws. He was hospitalized for more than two months.
