It’s a big deal that Jeff Boggess’ argument at Dallas’ Fifth Court of Appeals saved Gloria’s Restaurants’ trade-secrets case from a trial court’s no-evidence summary judgment dismissal. It’s an even bigger deal that the Fifth Court ruled his way in a rare, sua sponte, full-court decision.

“After oral argument, the entire court got in on this case—and nobody had asked for that,” said Boggess, an Addison solo who says he’s never seen the Fifth Court issue an en banc decision before a three-member panel could issue a ruling. “And on a 9-3 split, they reversed the judgment of the trial court and remanded it for further proceedings.”
