Lawyers counsel clients on conducting workplace investigations. If we need to investigate someone in our firms, we need to follow our own advice. Why? Lawyers think we are special, a cut above others; we believe that we know best for others and thus can figure out what is best for ourselves. We conclude we are professionals and thus immune from being all too human. No, we are not. So, here are some suggestions.
Ask if someone inside or outside the firm should conduct any investigation. The answer varies, but the need to ask the question doesn’t. Hindsight always kicks in; others later will ask, “Didn’t you see the conflicts of interest?” or “Wasn’t it clear that the managing partner was too close to her longtime friend to make an unbiased decision?”
