A Democratic lawmaker is seeking an attorney general opinion about what legal authority allows Gov. Rick Perry to spend taxpayer money for a criminal defense lawyer to represent Perry in an investigation into a 2013 veto.

“I think there’s a question that everybody is talking about … whether or not the taxpayer dollars can be used for criminal defense,” said Rep. Joe Deshotel, D-Beaumont. He wrote an April 25 opinion request to Texas A.G. Greg Abbott.
