Texas Civil Practice and Remedies Code Chapter 150 requires "the plaintiff" in "any action or arbitration proceeding for damages arising out of the provision of professional services by a licensed or registered professional" architect, engineer, land surveyor, or landscape engineer to file a supporting expert affidavit with the complaint. Cross-claimants and third-party plaintiffs are not "the plaintiff" in an "action or arbitration proceeding." The court of appeals' judgment upholding the trial court's dismissal is affirmed.
