Even after a jury awarded punitive damages to his client who had filed an employment discrimination claim against Microsoft Corp., plaintiffs lawyer Paul Morin knew he still faced challenges to win a sizable final judgment.

But earlier this month, despite the caps federal and state laws impose on employment discrimination damage awards, Morin’s client won nearly $2 million. In an Oct. 2 final judgment in Mercieca v. Microsoft, 353rd District Judge Tim Sulak ordered Microsoft to pay $1.96 million, including $960,000 in pre-appeal attorney fees, at a post-judgment interest rate of 5 percent.
