Senior Judge Bert Richardson said he would rule Nov. 12 or 13 on arguments by Gov. Rick Perry’s lawyers, who alleged that the prosecutor in the case is acting “illegally” because he didn’t follow the right process to take his oath of office.
It was the first pretrial hearing the governor had to attend in his felony case. Perry’s attorneys set the hearing to consider the oath issue and a second request for Richardson to order special prosecutor Michael McCrum to provide the judge a transcript of the Perry grand jury investigation. But Richardson determined that he would only hear arguments about the oath and would tackle the transcript question later.
