Applying a 2013 law, a divided Texas Court of Criminal Appeals has ordered a new trial for a man convicted of killing a toddler based on the testimony of a medical examiner who later said she could no longer stand by her trial testimony regarding the cause of death.
In a 5-4 decision Nov. 26 in Ex Parte: Robbins, the CCA set aside Neal Hampton Robbins’ capital murder conviction and life sentence assessed for the toddler’s 1998 death, and ordered that he be remanded to the Montgomery County sheriff to answer the charges against him.
