The last of three defendants accused of attempting to bribe U.S. District Judge Sam Sparks must face sentencing on Feb. 2 after a federal judge rejected the defendant’s unusual request to withdraw his guilty plea.
Federal rules allow a defendant to withdraw a guilty plea that was entered before a magistrate judge if a district judge hasn’t yet accepted the plea. But U.S. District Judge Donald E. Walter of Louisiana wrote in his order in United States v. Cessa that there was “clear evidence of actual, or most certainly implied, acceptance” of Francisco Antonio Colorado Cessa’s guilty plea.
