Immigration developments of recent can be characterized as unexpected, contradictory and controversial. Most of those watching these developments from the sidelines would expect this to apply solely to President Barack Obama’s executive action, viewed as a holiday gift by some and a nightmare before Christmas by others. However, the executive order has only added another dimension to the already complicated world of immigration.
Although the president has announced immigration changes that could help millions in the U.S. obtain temporary status and work authorization, the executive orders are yet to be implemented, and companies and individuals continue to operate under the current immigration laws and face related responsibilities and liabilities. The excitement surrounding the executive measures has detracted attention from record-high federal enforcement efforts. Employers, lulled by the hope of legalization for illegal workers and under the impression that the immigration authorities’ attention is aimed, primarily, at criminal aliens, may be tempted to relax immigration compliance.
