The Fifth Circuit gets a bad rap on being anti-plaintiff in employment cases. But it did a lot yesterday to nuke that image by denying en banc review (by an 11-4 vote) in Thompson v. Waco.

Here are the facts of the case: Three police detectives get suspended for falsifying time sheets. Two white detectives return to work without any restrictions, but a black officer is given various restrictions, including not being allowed to log in or search evidence. Sort of the things a detective does, at least from what I gather from “CSI” and “Law and Order.”
