The plaintiffs bar and some lawmakers harshly criticized a state representative’s proposal to prohibit an uninsured driver who was in a car wreck from suing for noneconomic or exemplary damages.

“This allows wrongdoers to be unaccountable for the harm they caused. Not having insurance doesn’t cause car wrecks—unsafe driving causes car wrecks,” John McCraw, vice president of legislative affairs for the Texas Trial Lawyers Association, told members of the House Judiciary & Civil Jurisprudence Committee during a March 3 hearing on House Bill 820 by Rep. Ed Thompson, R-Pearland.
